Terms and Conditions
By requesting a commission, the Client (you) and the Artist (eoamw0) agree to the following terms of use for the rendered services and/or goods delivered.Stages and Progress of Work
The Artist promises to deliver the agreed-upon service(s) and good(s) to the Client.Request and Approval
The Client begins a request detailing Project specifications and requirements. The Artist reserves the right to deny any requests that they may not be able to fulfill due to, but not limited to: time constraints, missing required design documents, different specializations required, request does not match product description, etc.Payment and Refunds
The Artist will not start the request until the payment amount due has been made in full. A full refund (minus any non-refundable payment processing fees) is available if work hasn’t started. Refunds are not available once work has begun or after final delivery. If the Artist is unable to complete the commission for any reason, a full refund (minus any non-refundable payment processing fees) will be issued to the Client.Progress and Revisions
Unless otherwise specified, the Client can expect work in progress updates (either in writing or screenshots) of the commission. Depending on the service requested (e.g., SURPRISE ME and SKEB type commissions are exempt from revisions), the Client is entitled to a maximum of two (2) revisions during the update stages. The Artist is responsible for ensuring these revisions correctly reflect the Client’s requests before continuing.Final Delivery
On final delivery the Client will receive the files defined in the initial request. To ensure a timely final delivery, the Client is expected to reply in a reasonable manner to ensure the project is delivered within the timeframe. If the Client does not respond within three (3) business days, the project timeline may be extended or the project may be suspended. The Artist will reply within a 48-hour window during business days.Usage Rights & Copyright
The Artist grants the Client a License to Use upon completion of the payment and adherence to these terms. The Artist reserves the right to revoke usage licenses or intellectual property rights in the event of a breach of contract, non-payment, or misuse of the delivered work. The Artist will not reuse or resell the specific commissioned artwork to other clients.Personal Use
The Client intends to use this for non-profit, private use (e.g., wall art, profile pictures, social media sharing). Credit attribution does not need to be featured prominently but must be mentioned or discoverable.Commercial Use
The Client intends for use in for-profit projects (e.g., streaming assets, game art, video assets). Credit attribution does not need to be featured prominently but must be mentioned or discoverable.Merchandising
Strictly prohibited. Do not create or sell physical goods or digital merchandise based on the Artist's work.Misuse Clause
The Client may not use the rendered goods/services in generative AI, NFTs, or related technologies. The Client may not claim authorship of the work.Intellectual Property Usage
The Client has majority ownership or primary ownership of related IPs in the request OR has the required permissions to use any IPs involved in the request.The Artist reserves the right to share the work in their portfolio, social media, show work in progress on streams or video recordings, unless a non-disclosure agreement is signed and a “Privacy Fee” is paid.
